Court order preserves transparency of College discipline decisions

This week, a panel of the Ontario Divisional Court unanimously ruled in favour of the College, dismissing an Ontario Certified Teacher’s request to have a notation of disciplinary action removed from our public register.

In December 2014, the College member was found guilty of professional misconduct for using inappropriate language towards a student. The Discipline Committee ordered a penalty, which included a reprimand and terms, conditions, or limitations (“TCLs”) in the form of coursework. The Discipline Committee further ordered that the fact of the reprimand be recorded on the public register.

In accordance with the statute and bylaws, a notation of the fact of the reprimand and TCLs was added to the member’s public register page. Today, the notation of the fact of the reprimand remains on the register.

The member requested that the notation be fully removed from the member’s public register page (which is accessible through the College’s web site), but the Court dismissed her request.
