1. Call to Order/Welcome

The Presiding Officer, George Merrett, called the meeting to order at 9:05 a.m. and welcomed all present.

The Chair, Larry M. Capstick, welcomed new Council members Pauline Demers and Sheila Gifford.

It was noted that Steering was comprised of Solette N. Gelberg and Marilyn Laframboise.

2. Agenda (GC20020927-128)

Harry Mulvale requested that copies of the text of the petitions handed to the Ontario College of Teachers by the Elementary Teachers' Federation of Ontario and the Ontario English Catholic Teachers' Association at the Annual Meeting on June 8, 2002 be distributed to the members of Council. It was agreed to add these items under the heading "Correspondence".

It was agreed that a discussion and review of the Annual Meeting of Members be held at the December 12-13, Meeting of Council.

It was moved by Steering, and

That the Revised Agenda for the September 27, 2002 Council meeting be approved as amended.

3. Minutes

3.1 Meeting, June 6-7, 2002 (GC20020927-129)

It was moved by Steering, and

That the Minutes of the Council Meeting held on June 6-7, 2002 be approved.

3.2 Special Meeting, September 12, 2002 (GC20020927-131)

It was moved by Steering, and

That the Minutes of the Special Meeting of Council held on September 12, 2002 by teleconference be approved.

4. Business Arising

There were no items under business arising.

5. Registrar’s Report (GC20020927-133)

The Registrar’s Report was received. The Registrar, J.W. (Joe) Atkinson, spoke to the report.

The Registrar congratulated George Merrett on being awarded an honorary membership in the Elementary Teachers' Federation of Ontario.

He advised that the College had not yet received the Accreditation Regulation from the Ministry.

A question and answer session followed the presentation of the Registrar's report.

6. Committee Reports

6.1 Finance Committee (GC20020927-142, 143, 144, 145, 190, 192)

The report of the Finance Committee was received. The Chair, Solette N. Gelberg, spoke to the report and answered questions.

Solette N. Gelberg gave a powerpoint slide presentation and provided a page-by-page analysis of the proposed 2003 Budget of the Ontario College of Teachers. A question and answer session followed.

A copy of the Ontario College of Teachers Reserves Estimate for 2003 to 2005 (GC20020927-190) was distributed to the members.

It was moved by Steering, "That Council approve the 2003 Budget of the Ontario College of Teachers with operating expenses of $28,768,000 and capital and deferred charges of $2,075,000."

It was moved by Doug Carter, seconded by Nancy Hutcheson, but

That the motion of the Steering Committee regarding the 2003 Budget be amended to read:

That Council approve the 2003 Budget of the Ontario College of Teachers with operating expenses, exclusive of the Professional Learning Program, of $21, 543,000 and capital and deferred charges of $1,441,000 and with Professional Learning Program operating expenses of $7,225,000 and capital and deferred charges of $634,000.

Diane Leblovic distributed a copy of a memo dated September 27, 2002 (GC20020927-192) with respect to the Standards of Practice and Education Committee budget for 2003.

It was moved by Diane Leblovic, seconded by Karen Mitchell, "That the 2003 Budget of the Ontario College of Teachers be amended by transferring $33,000 from the budget line 9.3 "Other Print Projects" which would now read $427,000 to the budget line 10.2 Standards of Practice and Education which would now read $148,000."

Harry Mulvale stated that the above motion was out of order because it did not reference the main motion.

The Presiding Officer ruled the motion in order.

Harry Mulvale challenged the ruling of the Presiding Officer.

A vote was taken, and the ruling of the Presiding Officer was upheld.

Harry Mulvale requested a recorded vote on the ruling.

The following Notice of Motion was read into the Minutes:

Moved by Solette N. Gelberg, Chair, Finance Committee:

That Council amend Subsection 21.04 of the Bylaws of the Ontario College of Teachers by substitution so that 21.04 would read:

21.04 The annual fee shall be:

  1. $139 for 2003
  2. $139 for subsequent years, or as may be amended from time to time by the amendment of these bylaws.

6.2 Executive Committee/Chair’s Report (GC20020927-134)

The report of the Executive Committee/Chair was received. The Chair, Larry M. Capstick spoke to the report.

The Chair thanked Marilyn Laframboise for attending the Ontario Teachers' Federation 2002 Annual Meeting on behalf of Council.

The Chair reported that the Executive Committee had met during the lunch hour that day to recommend that Council appoint Pierrette Nadeau to fill the vacancy for the French-language Roman Catholic School Board - Secondary category.

6.3 Investigation Committee (GC20020927-135, 136)

The reports of the Investigation Committee were received. The Chair, Harry Mulvale, spoke to the reports. He welcomed Janet Ouellette to the Committee.

Harry Mulvale expressed his thanks on behalf of the Committee for the work Laurent Joncas had done for the Investigation Committee.

6.4 Discipline Committee (GC20020927-137)

The report of the Discipline Committee was received. The Chair, Bernard J. Adam, spoke to the report.

6.5 Fitness to Practise Committee (GC20020927-138)

The report of the Fitness to Practise Committee was received. The Chair, Margaret Dempsey, spoke to the report.

6.6 Registration Appeals Committee (GC20020927-139, 140)

The reports of the Registration Appeals Committee were received. The Chair, Doug Carter, spoke to the reports and answered questions.

6.7 Professional Learning Committee (GC20020927-141, 168)

The reports of the Professional Learning Committee were received. The Chair, Elayne McDermid, spoke to the reports and answered questions.

6.8 Standards of Practice and Education Committee (GC20020927-146, 147, 177, 186)

The reports of the Standards of Practice and Education Committee were received. The Chair, Diane Leblovic, spoke to the reports and answered questions.

It was moved by Diane Leblovic, Chair, Standards of Practice and Education Committee, and

CARRIED,

That Council approve,

a. the amendment of the title of the Special Education qualification in Schedule D of Regulation 184/97 — Teacher’s Qualifications to read,

Special Education — All Exceptionalities

b. the amendment of Schedule C of Regulation 184/97 — Teacher’s Qualifications to include the following five one-session courses,

Special Education — Behaviour

Special Education — Communication

Special Education — Intellectual

Special Education — Physical

Special Education — Multiple

c. that the proposed amendments to Regulation 184 — Teacher’s Qualifications submitted to the Ministry of Education in 2000 be updated to reflect these changes.

It was moved by Diane Leblovic, Chair, Standards of Practice and Education Committee, and

CARRIED,

That Council approve that the current definition of a "program of professional education" in Regulation 184/97 — Teacher’s Qualifications be amended to read as follows,

(a) a concentrated study of,

(i) the primary and junior divisions, with or without a focus on the teaching of French as a second language,

(ii) the junior division and one optional course from Schedule A that is in the intermediate division and a course related to grades 7 and 8 of the intermediate division,

(iii) the intermediate and senior divisions including two optional courses from Schedule A, or,

(iv) technological studies, including a minimum of two optional courses from schedule B at the basic level, or one optional course from Schedule B at the basic level and the other such course at the advanced level,

(b) studies in education including learning and development throughout the primary, junior, intermediate and senior division,

(c) teaching methods designed to meet the individual needs of pupils, including students with behaviour, communication, intellectual, physical, or multiple exceptionalities.

(d) the acts and regulations respecting education,

(e) a review of the curriculum guidelines issued by the Minister related to all of the divisions and a study of curriculum development, and

(f) a minimum of 40 days of practical experience in schools or in other situations approved by the College for observation and practice teaching;

and that the proposed amendments to Regulation 184 — Teacher’s Qualifications submitted to the Ministry of Education in 2000 be updated to reflect this change.

6.9 Accreditation Committee

6.10 Human Resources Committee (GC20020927-148)

8. New Business

8.1 Revised Professional Advisory on Sexual Misconduct (GC20020927-163, 164)

It was moved by Steering, and

CARRIED,

That Council amend the Professional Advisory on Sexual Misconduct by substituting the attached text as contained in GC20020927-163, Attachment 1, “Professional Advisory - Professional Misconduct Related to Sexual Abuse and Sexual Misconduct”.

8.2 College Recognition of Retirees (GC20020927-165, 166)

It was moved by Steering, and

CARRIED,

That Council direct the Registrar to discontinue issuing formal certificates of recognition to members who notify the College of their retirement from the teaching profession.

8.3 Accreditation Regulation

The Registrar advised that the Minister of Education had not yet forwarded the Accreditation Regulation to the College.

8.4 Allowable Travel and Living Expenses (GC20020927-169)

It was moved by Larry Mongeon, seconded by Sterling Campbell, and

CARRIED,

That the College explore with Canada Customs and Revenue and the relevant ministers a clarification regarding allowable costs for travel and living expenses for those teachers having to travel more than 50 km to attend courses required to fulfill licence requirements.

9. Notices of Motion

9.1 Bylaws Amendment - Section 26 - Information to be removed from the Register

The following notice of motion was read into the minutes:

Moved by Doug Carter:

That the Bylaws of the Ontario College of Teachers be amended by the addition of Section 26.03 to read:

26.03 That the names of members who have been listed on the public register as "suspended - non payment of fees" for five consecutive years be removed from the public register and retained on the internal register for historical purposes.
